Hire Terms and Conditions
Welcome to Oz Photo Booths! We are delighted to provide you with our photo booth rental services. Please carefully review the following Terms of Service (“Terms”) that outline the agreement between you (referred to as “Customer,” “You,” or “Your”) and Oz Photo Booths (referred to as “Company,” “We,” “Us,” or “Our”) regarding the use of our photo booth rental services. By booking our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
Rental Agreement
Rental Period: The rental period begins at the agreed start time and ends at the agreed end time. Additional charges may apply for extending the rental period beyond the agreed time.
Booking Confirmation: Your booking is confirmed only after you have made the required payment and received a confirmation from us. We reserve the right to cancel or reschedule a booking if unforeseen circumstances arise, in which case a full refund will be provided.
Equipment Use: Our photo booth and related equipment shall be used solely for its intended purpose and in accordance with our instructions. Any damage caused due to misuse, neglect, or intentional actions will be the responsibility of the customer and may incur additional charges.
Payment and Cancellation
Payment: The rental fee and any applicable taxes are due in full at the time of booking, unless otherwise agreed upon in writing. All prices exclude GST unless otherwise stated.
Cancellation by Customer: In the event of cancellation, the following refund policy applies:
- If the cancellation is made 30 days or more prior to the rental date, a full refund less the deposit will be provided.
- If the cancellation is made within 30 days of the rental date, no refund will be provided.
Cancellation by Company: We reserve the right to cancel a booking due to unforeseen circumstances or if we believe the event may breach our policies or local laws. In such cases, a full refund will be provided.
Delivery and Travel Fees
Travel within 60km of Melbourne CBD (one way) is complimentary. Where the one-way distance exceeds 60km (i.e. return distance exceeds 120km), a travel fee of $3 per km applies to the excess, calculated on the return distance less 120km. Parking in Melbourne CBD is to be arranged and paid for by the client.
Delivery, set up and removal of the equipment are free of charge. Time taken to deliver, set up and remove the equipment will be outside the rental period. The booth attendant will aim to arrive 1.5 hours prior to hire time to set up. Earlier setup time can be arranged in discussion with Oz Photo Booths and an idle fee may apply if setup begins more than 5 hours before the designated hour. A booth attendant will always be within close proximity of the equipment to ensure smooth running.
Liability and Indemnity
Customer Responsibility: The customer is responsible for the conduct of all event participants using the photo booth. Any damage to the photo booth or other equipment caused by event participants will be the customer’s responsibility and may result in additional charges.
Liability: We shall not be held liable for any loss, damage, injury, or claims arising out of or related to the use of our services, equipment, or props. This includes but is not limited to any direct, indirect, incidental, or consequential damages.
Indemnity: The customer agrees to indemnify, defend, and hold harmless Oz Photo Booths, its employees, and agents from any claims, demands, damages, costs, and expenses arising from the customer’s use of our services.
Force Majeure
Oz Photo Booths will not be liable for failing to perform under this Agreement due to events beyond our reasonable control, including labour disputes, internet or service outages, third-party service failures, fire, natural disasters, war, or acts of terrorism.
If this happens, we’ll make all reasonable efforts to deliver the service or arrange a suitable replacement. Where that’s not possible, the client will receive a full or partial refund at our discretion.
Oz Photo Booths’ total liability is capped at the booking cost, excluding any indirect or consequential loss.
Intellectual Property
Photo Rights: The customer retains all rights to the photos taken during the rental period. However, we reserve the right to use these photos for promotional purposes, including but not limited to our website, social media, and marketing materials.
Proprietary Materials: All materials provided by us, including but not limited to logos, designs, and software, remain our exclusive property. No part of these materials may be reproduced or used without our prior written consent.
We will remove images if requested in writing, and will not display any images before an event if notified in writing beforehand. We will not use images which are deemed unsuitable on the website or for advertising and will not use any content that may be personally damaging to any person.
Rescheduling
In the event that the Customer requires a rescheduling of the booked service, Company will make reasonable efforts to accommodate such requests, subject to availability. However, it is acknowledged by both parties that Company may not be able to provide the services on the requested rescheduled date due to prior commitments or other limitations. In such cases, Company reserves the right to provide alternative dates for the provision of services, or if no suitable alternative is available, to cancel the booking upon mutual agreement between both parties. Any fees or deposits paid by the Customer shall be subject to the terms of cancellation outlined in this agreement.
Attendants/Staff
For formal events, we’d appreciate if a supplier meal could be provided for the attendant on bookings over 3 hours.
Miscellaneous
Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
Modification: We reserve the right to modify or update these Terms at any time without prior notice. The updated Terms will be effective from the date of publication on our website.
Entire Agreement: These Terms constitute the entire agreement between you and Oz Photo Booths regarding the use of our services and supersede any prior agreements or understandings.
